BIRTH STORY SESSION CONTRACT & POLICIES
This Birth Story Session Agreement (“Agreement”) is made between Phrozen Photography (“Photographer”) and the undersigned client (“Client”) for birth photography services. By booking and submitting payment, the Client agrees to all terms below.
3. BIRTH STORY COVERAGE
The Photographer is on-call for Birth Story clients from 38–42 weeks except during Shabbat
observance.
If the Client gives birth during Shabbat and the Photographer is unavailable:
• The Client receives a complimentary Fresh 48 Session, and
• A partial refund of 20% of the total Birth Story fee
This is the only compensation provided. Clients may choose to arrange a backup photographer for Saturday coverage.
2. SHABBAT OBSERVANCE
The Photographer observes Shabbat and is fully unavailable from Friday at 12:00 AM (midnight)
through Saturday at 11:59 PM. During this period:
• No communication
• No travel
• No work
• No sessions
• No birth coverage
Availability resumes at 12:00 AM Sunday morning.
1. RETAINER & PAYMENT TERMS
1.1 A 30% non-refundable retainer is due at the time of booking. ($280.00)
1.2 No date or due-date window is reserved until the retainer is received.
1.3 The remaining balance is due no later than 37 weeks of pregnancy. ($420.00)
1.4 Failure to pay the remaining balance by 37 weeks releases the Photographer from all on-call obligations.
1.5 Payments are non-refundable except as outlined in Section 12 (Emergency Clause).
2. ON-CALL PERIOD
2.1 Photographer will be on-call from 38 weeks through 42 weeks of pregnancy.
2.2 “On-call” means Photographer agrees to maintain open communication, keep schedule flexible, and be prepared to arrive within a reasonable time frame once notified of active labor.
3. CLIENT RESPONSIBILITY TO COMMUNICATE
3.1 Client agrees to notify Photographer at the following times:
• Early labor signs
• When contractions become regular
• When water breaks
• When departing for the birth location
• When medical provider confirms active labor
3.2 Photographer aims to arrive during active labor (typically 4–6 cm dilation or consistent contractions).
4. COVERAGE DETAILS
4.1 Photographer will provide 4–8 hours of coverage, depending on labor progression.
4.2 Coverage includes:
• Active labor
• Delivery (as allowed)
• First hour postpartum
• Bonding and early newborn details
4.3 Photographer may pause or rest during extremely long labors but will communicate clearly with Client.
5. LOCATION POLICIES
5.1 Client is responsible for confirming photography privileges with:
• Hospital
• Birth center
• Midwife/OB team
5.2 Photographer is not liable for denied access by staff or facility.
6. PHOTOGRAPHIC STYLE & LIMITATIONS
6.1 Client acknowledges familiarity with Photographer’s natural, documentary style.
6.2 Photographer retains full artistic discretion regarding angles, lighting, and editing.
6.3 Photographer will not capture explicit crowning or medical procedures unless requested in writing.
6.4 Flash will only be used with permission from Client and birth team.
7. PRIVACY & SHARING RIGHTS
7.1 Photographer will not share birth images publicly without written permission.
7.2 A model release form will be provided separately for optional approval.
7.3 Client may request full privacy at any time.
8. MISSED BIRTH CLAUSE (FAST LABOR)
8.1 If the Photographer cannot arrive due to:
• Rapid labor
• Precipitous birth
• Late notification by Client
The Client will receive a FREE Fresh 48 Session within 24–48 hours after birth.
8.2 No refunds are issued for missed births under these circumstances.
9. RESCHEDULING & CANCELLATION
9.1 Birth sessions cannot be “rescheduled,” as they rely on the on-call window.
9.2 Retainers are non-refundable.
9.3 Canceling after Photographer has entered the on-call window (38+ weeks) forfeits all payments made.
10. IMAGE DELIVERY
10.1 Client will receive 40–80 edited images delivered via a private, password-protected online gallery.
10.2 Delivery timeframe is 2–3 weeks after the birth.
10.3 RAW/unedited images are not provided.
11. LIABILITY
11.1 Photographer is not responsible for:
• Medical restrictions
• Facility photography limitations
• Labor complications
• Unexpected medical situations
• Emergency birth circumstances
• Failure of staff to permit photography
11.2 Photographer will make every reasonable effort to provide safe and respectful service.
12. EMERGENCY CLAUSE
12.1 In the event the Photographer experiences a serious emergency (illness, injury, or unavoidable event):
• Client may choose a full refund, OR
• Photographer will attempt to provide a qualified backup photographer, if available.
12.2 This clause applies only to true emergencies and not general scheduling conflicts.
13. AGREEMENT ACCEPTANCE
By booking the Birth Story Session and paying the retainer, the Client acknowledges that they have read, understood, and agreed to all terms listed above.
